Mere access to the Portal, completing forms, sending requests for information, queries, complaints, recruitment offers, curriculum vitae and, in general, any act of a similar nature to the aforementioned, carried out through the forms and/or electronic mailboxes on the Portal implies, on your part, unreserved acceptance of each and every one of the rules that are integral to the Legal Notice and your acceptance of being considered a Portal user. Therefore, you should carefully read and understand the content of the following Legal Notice:

Aguas y Servicios de la Costa Tropical de Granada AIE. (hereon in, the Entity), belonging to the FCC Group (www.fcc.es), is the owner of this web portal (heron in, the Portal). It is located in Plaza de la Aurora, s/n 18600 de Motril (Granada) and its CIF is V-18404368.
The Entity is registered in the Central Mercantile Register of Granada, Volume 707, Sheet 172, Page 9562.
The domain name through which you are accessing the Portal is the owner of the Entity.
Said domain name may not be used in connection with other content, products, or services that are not owned by the Entity and/or the FCC Group in any way that may cause confusion between the end users or that may discredit the Entity and/or the FCC Group.
2. Purpose
Legal Notice contains the conditions governing access to, navigation, and the use of this Portal, as well as the responsibilities arising from its use, provision, and/or contracting of products or services that may be offered, as well as the content comprising them, without prejudice that the Entity may establish specific conditions governing the use, provision, and/or contracting of products or services that might be offered to users through the Portal. In any case, these particular conditions form an integral part of this Legal Notice.
Mere access to the Portal, completing forms, sending requests for information, queries, complaints, recruitment offers, curriculum vitae and, in general, any act of a similar nature to the aforementioned, carried out through the forms and/or electronic mailboxes on the Portal implies, on your part, unreserved acceptance of each and every one of the rules that are integral to the Legal Notice and your acceptance of being considered a Portal user. Consequently, you should carefully read and understand the content of this Legal Notice.
Where the use, provision, and/or contracting of products or services is offered through the Portal, the fact of their use and/or request by the User also implies their unreserved acceptance of the particular conditions that, in turn, may have been established for this purpose, and which shall form an integral part of this Legal Notice.
3. Access and use of the portal
By its nature, the Portal may be freely accessed by its Users at no cost to them. However, the use, provision and/or contracting of products or services that, in turn, might be offered by the Entity may be subject to the prior observance of formal requirements such as completion of the corresponding form, payment of expenses or fees, and/or previous acceptance of the particular conditions that result from their application.
Mere access to the Portal does not in itself imply the establishment of any type of link or commercial relationship between the Entity and the User, except when the appropriate means have been established for this and the User has previously fulfilled the requirements that, if applicable, are established.
Inclusion of information relating to products or services offered by the Entity on the Portal is for information and advertising purposes only, unless expressly stated otherwise.
If, in order to use, provide, and/or contract a product or service offered through the Portal, the User should proceed with their registration, they will be responsible for providing truthful and lawful information, and guaranteeing the authenticity of all the data that they record when completing the pre-established forms in order to access the products or services in question. If, as a consequence of the registration, the User is given a password, they undertake to use it diligently and keep it secret. Consequently, Users are responsible for the proper custody and confidentiality of any identifiers and/or passwords provided to them by the Entity, and undertake not to assign their use to third parties, whether temporarily or permanently, or to allow access to these details to outside parties. The use and/or contracting of products or services by any illegitimate third party via such a password for these purposes because of lack of due diligence or loss of the password by the User is the sole responsibility of the User.
By virtue of the above, it is the User’s obligation to notify the Entity immediately, of any information that may allow the improper use of identifiers and/or passwords, such as theft, loss, or unauthorized access to such details, so that it may proceed with its immediate cancellation. Until such events are reported, the Entity shall be exempt from any liability that may arise from the misuse of identifiers or passwords by unauthorized third parties.
In any case, access, navigation, and use of the Portal and, as the case may be, the use or contracting of the services or products offered through it, is done under the sole and exclusive responsibility of the User, who undertakes to diligently and faithfully observe any additional instructions given by the Entity, or by personnel authorized by the Entity, regarding the use of the Portal and its content.
Therefore, the User undertakes to use the content, products, and services on the Portal with due diligence, in a correct and lawful manner, in accordance with current legislation and, in particular, undertakes to refrain from:
Using them in a way or for purposes that are contrary to the law or are immoral, or against generally accepted good customs, public order, or instructions received from the Entity.

4. Responsibilities and limitations
The Entity cannot guarantee the trustworthiness, usefulness, or veracity of information provided through the Portal.
Consequently, the Entity does not guarantee and is not responsible for:
- The continuity of the content of the Portal and/or the lack of availability or accessibility of the Portal or its technical continuity.
- The absence of errors in said contents or products.
- The absence of viruses and other harmful components on the Portal or the server that supplies it.
- The invulnerability of the Portal and/or the impregnability of the security measures adopted in it.
- The possible lack of usefulness or performance of the contents or services of the Portal.
- Any damages or prejudices it may cause, in itself or to a third party, by any person who violates the conditions, norms, and instructions that the Entity establishes on the Portal, or by making its security systems vulnerable.
- Any other damages that may be caused by reasons inherent in the functioning or malfunctioning of the Portal or of the websites to which links may have been established.
Nevertheless, the Entity declares that it has taken all necessary measures within its reach and the possibilities of the current technology, to guarantee the operation of the Portal and to prevent the existence and transmission of viruses and other harmful components to its Users.
The Entity makes every effort to avoid errors in the contents that it publishes on the Portal. All the content offered through the Portal is updated and current, and the Entity reserves the power to modify them at any time. The Entity is not responsible for any consequences that may result from errors in content provided by third parties that may appear on the Portal.
Any communication or transmission of content that infringes the rights of third parties and whose content is threatening, obscene, defamatory, pornographic, xenophobic, infringes the dignity of a person or the rights of children, the current legislature, or any conduct that incites or constitutes a criminal offense.
Likewise, users are prohibited from including or communicating any content which may be false or inaccurate and which misleads or could mislead other users or employees of the Entity, in particular any content protected by any intellectual or industrial property rights belonging to third parties if it does not have the authorization of the owners, if it undermines or discredits the reputation or image of the Entity or of any integral member of the FCC Group, it is considered a case of illegal, deceptive, or unfair advertising, and/or if it incorporates a virus or any other electronic element which may damage or impede the operation of the website, the network, or the computer equipment of the Entity or third parties and/or access to the website by the other users.
The Entity may prohibit access to the Portal of any User that performs any of the behaviors referenced in this section, in an expository and non-limiting manner.
5. Intellectual and industrial property rights
The Entity holds or has obtained the corresponding licenses for the right to exploit its intellectual, industrial, and image rights over the contents available through the Portal, which, purely for illustrative purposes and not representing an exhaustive list, include texts, graphic designs, drawings, codes, software, photographs, videos, sounds, databases, indexes, images, trademarks, logos, expressions and information, and in general, any other creation protected by national norms and international treaties on intellectual and industrial property (hereon in, together referred to as, the Content).
All intellectual and industrial property rights over the Content are reserved, and in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute in any way, all or part of the Content included on the Portal, for public or commercial purposes, if the express prior written authorization of the Entity or, as the case may be, of the owner of the rights to which it corresponds, is not available.

In no case, unless expressly stated, does access to or use of the Portal and/or its Content, give the user any right to use the trademarks, logos and/or distinctive signs included in it and which are protected by law.
6. Links
6.1 Links from the Portal to other web pages
The Entity can provide links, directly or indirectly, to resources or web pages from the Internet that are located outside the Portal. The presence of these links on the Portal are for information purposes, and in no case constitute an invitation to contract the products and/or services that are offered or may be offered on the destination web pages of these links, nor does it imply the existence of a link or commercial relationship or of dependency with the titular entity of the linked web page. In these cases, the Entity will not be responsible for establishing the general and particular conditions to be taken into account in the use, provision, or contracting of these services by third parties and, therefore, cannot be held responsible for them.
The Entity does not have the power, or the human or technical means to know, control, or approve all the information, content, products, or services provided by other web pages to which links can be established from the Portal. Consequently, the Entity cannot assume any responsibility for any aspect related to the web pages to which a link can be established from the Portal, specifically, and as a non-exhaustive example, about its operation, access, data, information, files, quality, and the reliability of its products and services, its own links and/or any of its contents in general.
However, in the event that the Entity becomes aware that the activity or information which refers to it from such links is unlawful, constitutes a crime, or may damage property or the rights of a third party, it will act with necessary due diligence to delete or disable the corresponding link as soon as possible.
Likewise, if Users have an effective knowledge of the illegality of activities developed through these third party websites, they must immediately notify the Entity so that it can disable access to this link.
6.2 Links from other web pages to the Portal
If any User, entity, or web page wishes to establish any type of link pointing to the Portal, it must comply with the following provisions:
It must obtain the prior express and written authorization of the Entity.
The link can only be directed to the main page of the Portal, unless explicitly authorized otherwise.
The link must be absolute and complete, that is, it must take the User, via a click, to the main page and must completely cover the entire screen extension of the main page of the Portal. In no case, unless the Entity authorizes otherwise, can the website from which the link is made reproduce, in any way, the Portal, include it as part of its website, or within one of its “frames” or create a “browser” of any of the pages on the Portal.
The website from which the link is established cannot declare in any way that the Entity has authorized such a link, without this being the case. If the entity that makes the link from its page to the Portal wishes to correctly include the trademark, name, trade name, label, logo, or any other identifying sign of the Entity and/or Portal on its website, it must first obtain express and written authorization to do so from the Entity.

7. Privacy policy
When the User registers (among other reasons, to access services, request information, purchase products, submit queries, complaints, or recruitment requests, or send curriculum vitae), they must provide personal data, which will be collected and processed in accordance with, and in compliance with the principles set out in Organic Law 15/1999, of December 13, on the Protection of Personal Data (LOPD).
In this case, the User will be suitably advised of the need for them to provide their personal data. In case of providing an e-mail address or other means of electronic communication, the User expressly authorizes the Entity for such means to be used as a means of communication with the User, to respond to their request and/or query, as well as to be able to transmit information related to the Entity and inform the User of any other relevant changes that may have occurred in the Portal.
Such data processing is carried out in accordance with the aforementioned principles and, in particular, are subject to due confidentiality and secrecy, the Entity having adopted adequate security measures to avoid any alteration, loss, unauthorized access, or damage of the personal data and registered information.
The User has the right to access, rectify, cancel, or oppose (A.R.C.O) their information, and can exercise these rights by directing a postal communication to the address of the Entity provided on its website.
8. Duration and modification
The Entity reserves the right to modify this Legal Notice and/or the particular conditions that, if any, have been established for the use and/or contracting of the products or services provided through the Portal, when it deems it appropriate or with the purpose of adapting itself to legislative and technological changes, with its effects being valid from the time of publication on the Portal.
The temporary validity of these use conditions therefore coincide with the time of their being published, until they are totally or partially modified, at which time the modified conditions of use will become effective.
The Entity may terminate, suspend or interrupt, at any time and without prior notice, access to the Content of the page, without the possibility of the User demanding any type of compensation. Upon such termination, the prohibitions of use of the Contents set out above in this Legal Notice will remain in force.
9. Communication
Any communication between the Entity and the User, should be addressed to the Entity at its postal address and/or electronic address indicated above. In any case, the Entity will communicate with the User in accordance with the contact information they provided or facilitated. Expressly, the User accepts the use of their electronic mail address as a valid procedure for the exchange of information and the sending of communications between and/or with the Entity.
10. General
The headings of the various clauses are only for information purposes, and shall not affect, qualify, or extend the interpretation of this Legal Notice.
In the case of a discrepancy between the information established in this Legal Notice and the particular conditions that may be established in relation to the products or services offered in the Portal, the provisions of the particular conditions shall prevail.
In the event that any provision or provisions of this Legal Notice are deemed void or unenforceable, in whole or in part, by any judge, court, or competent administrative body, said nullity or non-application shall not affect the other provisions of the Legal Notice or, if applicable, any particular conditions that may have been established.
The non-exercise or execution by the Entity of any right or provision contained in this Legal Notice shall not constitute a waiver thereof, unless it is acknowledged and agreed in writing by this party.
11. Applicable law and legal jurisdiction
This Legal Notice and the relations established between the Entity and the User, in particular the understanding and resolution of any disputes, discrepancies, or differences that may arise, shall be governed and resolved in accordance with the provisions of the Spanish legislation regarding applicable legislation and competent jurisdiction.
However, for cases in which the law allows the parties the possibility of attending a court, the Entity and the User, expressly waiving any other jurisdiction that may correspond to them, will submit any controversy and/or litigation to the Courts and Tribunals in the city where the Entity is domiciled, as provided in this Legal Notice.
